Re-inventing Finance: An Emerging (Digital) Reformation ...

Several months ago, I was invited by Sean Park to be a Venture Partner with Anthemis Group, a new financial services group with an aim to totally reinvent finance from the ground up.

(Sean was a generous backer for the Future of Money Project I co-created for a SIBOS conference, and we?ve met up several times in the past few years for animated conversations about the changing nature of money, value and wealth.)

Last Thursday I had the great privilege of having been invited by the remarkable Laurent Haug to present a snapshot of our vision of the new emerging universe of ?digitally native finance? at the wonderful Lift12 conference in Geneva. Twenty minutes is not a long time (and thank goodness Laurent indulged me with a couple minutes more) to convey both the context and the substance of what we believe to be a fundamental shift in the paradigm of the financial services industry, but I hope I was able to give at least a good high-level overview. Most importantly, I hope I was able to convey the excitement we feel at the vastness of the opportunity and the win/win/win (for the customers/companies/economies) available to those who embrace the opportunity for technology-enabled disruption in financial services by introducing them ? however superficially I?ll admit ? to just a handful of companies who are at the vanguard of this wave of change.

Food is Happiness: Genwa Korean BBQ

I came to eat at Genwa for a friend's birthday with a group size of eight. We had a great time as the food, atmosphere, and service were all excellent. The only thing I felt wasn't great was the second grill on our table. It had a weak fire to it, resulting in the grilling taking much longer than the other table's.

A lot of Korean BBQ places in LA have pretty horrible service. I've seen servers give vegetarians meat in their entrees, not refill water, not ever ask how things are going, etc. At Genwa, they care, they really really do. For instance, my friend to my right is vegetarian. After bringing his dish out, another server has the courtesy to ask if he's vegetarian and if he needs anything else. How nice is that?

Not to mention that it was our friend's birthday, they made sure that the drinks and shots kept coming out, to which I think a few were free-- as they also drank with us! Obviously EVERYONE is there to have a good time.

The food was great, and everything went pretty smoothly for our group of eight. I would definitely head back there with friends to have a great evening of food, drinks, and friends. Oh, I almost forgot to mention that their ventilation there seems to be pretty good, as we didn't walk out smelling of Korean BBQ. Well, that may or may not be to your liking.

Mayor Bert Xanadu: Let?s build Transportainment City instead

EDITOR: It's circa 1973. Fictitious Bert Xanadu is the Mayor of Toronto and owner of the Imperial Six cinemas on Yonge Street. Mayor Xanadu has been governing from his twitter account over the last two years and now a regular series of posts straight out of 1973 and into Toronto comedic political fray.

The people of Toronto have told me that they wish to leave their houses and move about the city ? who am I to say no?!!
The dim bulbs, shiftless jerks and unshaven con men who purport to have plans for improving transit in this city have failed to ask the most fundamental question of all: why does Toronto need transit at all?

Be assured, I have asked ? and can now answer ? that question.

Torontonians have told me they need transit ? effective, fragrant, cheap and sexy ? mainly for the following reasons:

? ?I want to get out of the house?: 37%
? ?the vibrations of the subway car lull me into a womb-like trance?: 14%
? ?I want to see what other people look like?: 22%
? ?I left something somewhere else and need to go get it and bring it back?: 33%
? ?I might miss out on something?: 16%

So what?s the real problem?

It?s that we have more than enough transit ? but to solve only one need:? to get people to and from their hellish places of employment.? Hundreds of thousands of other non-productive citizens are greedily crowding the fume-filled buses and crabby streetcars, the eccentric trolleys and slippery subway platforms, the windswept bus stops and stalled escalators, making the short brutish lives of Toronto?s salary slaves even worse than they already are.

What we really need are new forms of transit that serve the under-served and transport the easily distracted.

We can do this not by building new subway lines, but by calling on the ingenuity of our nation?s finest engineers, psychiatrists and P.R. men to design and build a veritable network ? or indeed, an actual network! ? of comfortable propulsion devices, each made to suit but a fraction of the populace?s moving urges.

Whilst the greasy lobbyists, humourless bureaucrats and political toadies spend months haggling, seducing and annoying each other to develop such plans, I am boldly stepping forward today to table my 1974 plan.? I like to call it ?Transportainment City?.? You can call it what you want ? and you can call me what you want ? but don?t forget who dreamed it up while you are coasting comfortably on the Wychwood Park Golf Cart Circle Line with local egghead Marshall McLuhan as your driver!

Piggy-back rides? Conga lines? Complimentary rides in police sidecars?? Yes, but so much more!

Let?s start with the high school truants.? Reeking of cheap cigarellos and stale ale, their dungarees and floor-mop hairdos offensive to the eyes and to all that is civilized, these teenaged bums should be isolated as they traverse the Queen City, hooting and hollering merely to impress each other for some cheap psychological gain.? So my TeenQuest Line ? a fleet of open-backed pick-up trucks (each painted with currently popular symbols of ersatz masculine posturing, such as ?Wolfman Jack?, or Woody Woodpecker chomping on a cigar) -- will cruise up and down Yonge St. from Front to Steeles, 24 hours a day, carrying these louts, and louts only, on their aimless drives to social oblivion (transfers accepted).

Then there is the sub-constituency of those simply wish to be somewhere other than where they currently are, if only for a few hours, without arousing suspicion.? Lake-worthy ferries of the new Alibi Cruise Line will depart each morn at 8:30 am from docks at the base of the Scarborough Bluffs, and drift aimlessly all day, pointed generally towards the middle of Lake Ontario, arriving promptly back by 5pm. Each passenger will be presented with a bogus TTC paper transfer of their choice.

Next up: there are those who are in no particular hurry to complete their measly tasks ? why would we enlist powerful and expensive bus and train engines to transport these uncomplicated and unburdened little grey people? A 20-mile gently humming system of moving sidewalks, the Horizontoronto Line, moving at a contemplative 1 mile per hour, will criss-cross the city, offering a gentle breeze of forward movement to its users, while keeping them out of the way of the purposeful. No need to stand on the right ? no one?s walking past you anyway!

Cities need a vibrant downtown and an adjacent bland region of dormitory suburbs ? the sizzling bacon and cold eggs of urban planning.? Since hundreds of thousands of Etobicockettes, Willowdaleans, Scarboroughriders and other Metro Toronto outliers escape their flat monocultures during daylight hours to snake their way to soulless jobs in business district office towers, an opportunity presents itself.? The new Exurbia Triple-Decker Bus Line will carry deeply-bored downtowners through the unnecessarily curvy suburban streets, allowing them gaze down on, and sneer at, the vast garages, strange sidewalk-less thoroughfares and antiseptic lawns that they themselves will never personally trod upon.

Toronto, still statistically the beigest of the British Empire?s great cities, has been enlivened in recent years by new burly immigrants from more exotic and rustic shores, e.g.? Nova Scotia, Wales, New Zealand and the Kara-Kirghiz Autonomous Oblast ? all leading bastions of equestrian culture.? So when these uncouth but mighty workers arrive, why force them into the unfamiliar and trying inferno known as the Toronto subway system?? Instead, my new Horseflesh For Hire Conveyance Service will offer up the idle but cheerful horses of the Toronto Police Dept. ? hay and saddle included for an extra TTC token! ? to those who wish to gallop about, the intoxicating stink of freedom propelling them forward, according to their own schedule!

And what about, you might ask, the steaming waste products generated by these noble steeds each day on the streets of Toronto? It?s genius ? we?ll use the municipal manure to help fill in the vacant subway tunnels to nowhere!!

If I asked for a show of hands right now, the horizon would be clouded with arms thrusting upward in response to this question: who is sick of the snot-nosed and peculiar brats who inveigle their spineless parents to ride the TTC simply to enrage the rest of us??? I thought so.

So, with the generous 25-year sponsorship of local retail giants Sayvettes and Aikenhead?s Hardware, we will be unleashing the floats of the Santa Claus Parade every day of the year!? Undisciplined tykes can clamber on board the giant Bakelite facsimile of Canadian icon Raymond Burr, or the H.R. Pufnstuf-Mobile, made out of actual puff 'n stuff, and ride up and down University Avenue until they wet their pants.

Speaking of bodily fluids and transit, that brings me to vomit, or rather, to the topic of vomit.? We spend $457,000 each year on Javex to wash away the thousands of gallons of the bile freely-shared by after-hours drunks riding the infamous Yonge St. Vomit Comet.? Enough, I say.

Getting Better at Public Speaking

Statistics show more Americans are afraid of public speaking than they are of death. However, speaking in front of a crowd is almost inevitable. In fact, in many professions it is a part of the job every day. Public speaking and giving presentations do not have to be terrifying. There are a few simple steps for getting better at professional presentations and making speeches more effective.

First, know the material of the presentation. Most experts suggest having an overall topic, and then three main speaking points. Think of it like a bulleted list. The audience does not want to hear everything there is to know about the topic at hand. They want a short, easy to listen to and easy to digest version. They want to walk away having learned not everything there is to know about a particular subject, but just one or two new things. Keep the bullet points in mind and try not to stray from them too much.

Next, have note cards on hand.

Do not type out a full script or speech, rather, keep it in the form of main talking points. A key word here or there will do. A speaker does not want to sound as if he is reading an encyclopedia aloud. The goal is to sound as if it is part of a natural conversation.

When it is time for the presentation or speech, begin by taking deep breaths. The key is to not think too much about the task at hand. Go into it as if it is something normal, natural. The audience is not an enemy. Remember, everyone loves to laugh. If the audience gets a laugh out of the presentation or a fumble here or there, great. Nobody is perfect, and being able to laugh at mistakes is an endearing quality. An important thing to remember is the audience is uncontrollable.

Do not attempt to predict or manipulate what the audience will do or how it will respond. Let things happen on their own.

Finally, like most things in life, practice makes perfect. Practice speaking to small groups of people in social situations, and getting up and doing things in front of a crowd. Become comfortable having many sets of eyes on you, and remember, it doesn?t really matter what anyone is thinking. Many of them are perfect strangers. Soon, speaking in public will become second nature and even enjoyable.

Supreme Court Declines To Review ?New And Improved? Written ...

On Tuesday, the Supreme Court denied Centocor?s (now ?Janssen?) petition for cert. and so let stand a ruling that Centocor?s patents on humanized monoclonal antibodies (covering Abbott?s Humira) are invalid for failure to meet the written description requirement (WDR) ?of s. 112(1). Since cert. was not requested following the en banc decision in Ariad v. Lilly, which essentially reached the same conclusion on drugs ? not yet discovered ? that might alter the NF-kB pathway, this was the first good chance the Supreme Court had to weigh in on the heightened WDR that has been applied with regularity by panels of the Fed. Cir. to invalidate biotech patents claiming early stage inventions since it was articulated by Judge Lourie in the 1997 U. of Cal. v. Lilly decision. ?As I have written in a number of posts on subsequent decisions, this new and improved WDR has led biotech patentees down a trail of legal tears as, with few exceptions, their patents have failed the WDR ? even if the claims were arguably enabled by the specification?a question that the Fed. Cir. has increasingly refused even to consider once the increasingly easy button of the WDR has been used to invalidate ?the patent.

Furthermore, in the absence of divided opinions among the Fed. Cir. judges, a grant of cert. was even less likely. The current court can hardly be called divided on this issue.? Judges Rader and Linn wrote the only dissenting opinions in Ariad. I had a chance to review a slideshow Prof. Janice Mueller put together in 2003 as part of a presentation on WDR at AIPLA and the situation was much different. On a slide entitled ?Federal Circuit Views On WDR,? Janice (a former clerk for Judge Rich), put Rader, Linn and Gajarsa as on the side of ?tradition, tradition? (limiting WDR to deciding priority issues), noted Judges Michel and Dyk as on the fence, put Mayer Prost and Schall as ?undeclared? and lined up Judges Newman, Bryson, Clevenger, and Prost as siding with Judge Lourie in favor of the ?Expansive Application of WDR.? ?In 1993, I published a note in JPTOS Vol. 85, page 1, discussing the Fed. Cir.?s second look and reversal of its initial invalidation of the Enzo probe patents. It looked like the consensus of the court might move away from the ?make it or fake it? [my term] prescription of Lilly.

How almost a decade can change things! ?Judges Gajarsa, Dyk, Prost and Mayer have moved to the Lourie ?camp.? And there have been some new recruits, as Judge Moore voted with the majority in the Ariad en banc decision, which also included Judges Lourie, Newman, Bryson, Prost, ?Gajarsa and Dyk. Gajarsa also voted with Moore and Bryson in the recent BSC v. J&J decision which invalidated the rapamycin-releasing stent patents, and extended the reach of the new WDR into small molecule pharmaceuticals. Finally, the original Centocor panel decision was authored by Bryson, Clevenger and Prost. Game. Set. Match.

In this informal poll, I note that Judges O?Malley, Reyna and Wallach have not been heard from and, of course, Judge Michel has retired. Oscar night is supposed to be the night where dreams come true and careers are made, but for many actors over the years, it has marked the beginning of a downward trend. Among the list of past winners, you'll find some of Hollywood's most timeless faces. But you'll also find some names that have faded since their night of Oscar glory.

Through no fault of their own, some actors have struggled to escape from under the weight of an Academy Award win — especially if it came early in their career. Despite their best efforts, they have yet to repeat their previous levels of success and live up to the title "Academy Award winner."

Here are some of the steepest falls for Oscar winners in recent years:

Hilary Swank
Despite two wins for Best Actress, Hilary Swank's career maps out with two peaks and large valleys in between. Not counting her winning roles in "Boys Don't Cry" and "Million Dollar Baby," none of Swank's leading roles have caught much traction either financially or critically. Her more commercial choices like "P.S. I Love You" and "The Reaping" failed to capture their respective target audiences, and Oscar bait like "Conviction" and "Amelia" saw only mild critical response.

Cuba Gooding, Jr.
His iconic role in "Jerry Maguire" and the catchphrase that followed ("Show me the money!") marked the beginning of a steep and fast drop in Gooding's career. Embarrassing roles in films like "Snow Dogs" and "Boat Trip" became examples of how far an Academy Award winner could fall. Gooding has made some notable appearances in films like "Red Tails" and "Pearl Harbor," but his turn in "Radio" earned ridicule from Robert Downey Jr.'s character in "Tropic Thunder."

Renee Zellweger
After two previous nominations, Zellweger won her golden statue for "Cold Mountain" but has yet to earn similar praise since. NYPD monitored Muslim students

NEW YORK?? The New York Police Department monitored Muslim college students far more broadly than previously known, at schools far beyond the city limits, including the elite Ivy League colleges of Yale and the University of Pennsylvania, The Associated Press has learned.

Police talked with local authorities about professors 300 miles (480 kilometers) away in Buffalo and even sent an undercover agent on a whitewater rafting trip, where he recorded students' names and noted in police intelligence files how many times they prayed.

Detectives trawled Muslim student websites every day and, although professors and students had not been accused of any wrongdoing, their names were recorded in reports prepared for Police Commissioner Raymond Kelly.

Asked about the monitoring, police spokesman Paul Browne provided a list of 12 people arrested or convicted on terrorism charges in the United States and abroad who had once been members of Muslim student associations, which the NYPD referred to as MSAs. Jesse Morton, who this month pleaded guilty to posting online threats against the creators of the animated TV show "South Park," had once tried to recruit followers at Stony Brook University on Long Island, Browne said.

"As a result, the NYPD deemed it prudent to get a better handle on what was occurring at MSAs," Browne said in an email. He said police monitored student websites and collected publicly available information, but did so only between 2006 and 2007.

"I see a violation of civil rights here," said Tanweer Haq, chaplain of the Muslim Student Association at Syracuse. "Nobody wants to be on the list of the FBI or the NYPD or whatever. Muslim students want to have their own lives, their own privacy and enjoy the same freedoms and opportunities that everybody else has."

Playing by the rules
In recent months, the AP has revealed secret programs the NYPD built with help from the CIA to monitor Muslims at the places where they eat, shop and worship. The AP also published details about how police placed undercover officers at Muslim student associations in colleges within the city limits; this revelation has outraged faculty and student groups.

Though the NYPD says it follows the same rules as the FBI, some of the NYPD's activities go beyond what the FBI is allowed to do.

Kelly and New York City Mayor Michael Bloomberg repeatedly have said that the police only follow legitimate leads about suspected criminal activity.

But the latest documents mention no wrongdoing by any students.

In one report, an undercover officer describes accompanying 18 Muslim students from the City College of New York on a whitewater rafting trip in upstate New York on April 21, 2008. The officer noted the names of attendees who were officers of the Muslim Student Association.

"In addition to the regularly scheduled events (Rafting), the group prayed at least four times a day, and much of the conversation was spent discussing Islam and was religious in nature," the report says.

Praying five times a day is one of the core traditions of Islam.

Jawad Rasul, one of the students on the trip, said he was stunned that his name was included in the police report.

"It forces me to look around wherever I am now," Rasul said.

But another student, Ali Ahmed, whom the NYPD said appeared to be in charge of the trip, said he understood the police department's concern.

"I can't blame them for doing their job," Ahmed said. "There's lots of Muslims doing some bad things and it gives a bad name to all of us, so they have to take their due diligence."

City College criticized the surveillance and said it was unaware the NYPD was watching students.

"The City College of New York does not accept or condone any investigation of any student organization based on the political or religious content of its ideas," the college said in a written statement. "Absent specific evidence linking a member of the City College community to criminal activity, we do not condone this kind of investigation."

Browne said undercover officers go wherever people they're investigating go. There is no indication that, in the nearly four years since the report, the NYPD brought charges connecting City College students to terrorism.

Student groups were of particular interest to the NYPD because they attract young Muslim men, a demographic that terrorist groups frequently draw from. Police worried about which Muslim scholars were influencing these students and feared that extracurricular activities such as paintball outings could be used as terrorist training.

The AP first reported in October that the NYPD had placed informants or undercover officers in the Muslim Student Associations at City College, Brooklyn College, Baruch College, Hunter College, City College of New York, Queens College, La Guardia Community College and St. John's University. All of those colleges are within the New York City limits.

A person familiar with the program, who like others insisted on anonymity because he was not authorized to discuss it, said the NYPD also had a student informant at Syracuse.

Police also were interested in the Muslim student group at Rutgers, in New Brunswick, New Jersey. In 2009, undercover NYPD officers had a safe house in an apartment not far from campus. The operation was blown when the building superintendent stumbled upon the safe house and, thinking it was some sort of a terrorist cell, called the police emerency dispatcher.

The FBI responded and determined that monitoring Rutgers students was one of the operation's objectives, current and former federal officials said.

The Rutgers police chief at the time, Rhonda Harris, would not discuss the fallout. In a written statement, university spokesman E.J. Miranda said: "The university was not aware of this at the time and we have nothing to add on this matter."

Another NYPD intelligence report from Jan. 2, 2009, described a trip by three NYPD officers to Buffalo, where they met with a high-ranking member of the Erie County Sheriff's Department and agreed "to develop assets jointly in the Buffalo area, to act as listening posts within the ethnic Somalian community."

The sheriff's department official noted "that there are some Somali Professors and students at SUNY-Buffalo and it would be worthwhile to further analyze that population," the report says.

Browne said the NYPD did not follow that recommendation. A spokesman for the university, John DellaContrada, said the NYPD never contacted the administration. Sheriff's Departments spokeswoman Mary Murray could not immediately confirm the meeting or say whether the proposal went any further.

Another report, entitled "Weekly MSA Report" and dated Nov. 22, 2006, explained that officers from the NYPD's Cyber Intelligence unit visited the websites, blogs and forums of Muslim student associations as a "daily routine."

The universities included Yale; Columbia; the University of Pennsylvania; Syracuse; New York University; Clarkson University; the Newark and New Brunswick campuses of Rutgers; and the State University of New York campuses in Buffalo, Albany, Stony Brook and Potsdam; Queens College, Baruch College, Brooklyn College and La Guardia Community College.

"Students who advertised events or sent emails about regular events should not be worried about a 'terrorism file' being kept on them. NYPD only investigated persons who we had reasonable suspicion to believe might be involved in unlawful activities," Browne said.

Misgivings
But such assurances seem to offer little comfort to some former students.

One University at Buffalo student, Adeela Khan, did end up in a police report after receiving an email on Nov. 9, 2006, announcing an upcoming Islamic conference in Toronto. The email said "highly respected scholars" would be attending, but did not say who or give any details of the program. Khan says she clicked "forward," sent it to a Yahoo chat group of fellow Muslims and promptly forgot about it.

"A couple people had gone the year prior and they said they had a really nice time, so I was just passing the information on forward. That's really all it was," said Khan, who has since graduated.

Khan was a board member of the Muslim Student Association at the University at Buffalo at the time. She says she never went to the conference, was not affiliated with it and had no idea who was speaking at it.

But officer Mahmood Ahmad of the NYPD's Cyber Intelligence Unit took notice and listed Khan in his weekly report for Kelly. The officer began researching the Toronto conference and found that one of the speakers, Tariq Ramadan, had his U.S. visa revoked in 2004. The U.S. government said it was because Ramadan had given money to a Palestinian group. It reinstated his visa in 2010.

The officer's report notes three other speakers. One, Siraj Wahaj, is a prominent but controversial New York imam who has attracted the attention of authorities for years. Prosecutors included his name on a 3 ?-page list of people they said "may be alleged as co-conspirators" in the 1993 World Trade Center bombing, though he was never charged.

The other two are Hamza Yusuf and Zaid Shakir, two of the nation's most prominent Muslim scholars. Both have lectured at top universities in the U.S.. Yusuf met with President George W. Bush at the White House following the 2001 terrorist attacks.

The post about the academic event was enough to get Khan's name mentioned in the weekly MSA report, which was stamped "SECRET" in red letters and sent to Kelly's office.

There is no indication that the investigation went any further, or that Khan was ever implicated in anything. But she worries about being associated with the police report.

"It's just a waste of resources, if you ask me," she said. "I understand why they're doing it, but it's just kind of like a Catch-22. I'm not the one doing anything wrong."

The university said it was unaware its students were being monitored.

"UB does not conduct this kind of surveillance and if asked, UB would not voluntarily cooperate with such a request," the university said in a written statement. "As a public university, UB strongly supports the values of freedom of speech and assembly, freedom of religion, and a reasonable expectation of privacy."

The same Nov. 22, 2006, report also noted seminars announced on the websites of the Muslim student associations at New York University and Rutgers University's campus in Newark, New Jersey.

Recruiting
Browne, the police department spokesman, said intelligence analysts were interested in recruiting by the Islamic Thinkers Society, a New York-based group that wants to see the United States governed under Islamic law. Morton was a leader of the group and went to Stony Brook University's MSA to recruit students that same month.

"One thing that our open source searches were interested in determining at the time was, where do Islamic Thinkers Society go ? in terms of MSAs for recruiting," Browne said.

Yale declined comment. The University of Pennsylvania did not immediately respond to requests for comment. Other colleges on the list said they worried the monitoring infringed on students' freedom of speech.

"Like New York City itself, American universities are admired across the globe as places that welcome a diversity of people and viewpoints. So we would obviously be concerned about anything that could chill our essential values of academic freedom or intrude on student privacy," Columbia University spokesman Robert Hornsby said in a written statement.

Danish Munir, an alumnus adviser for the University of Pennsylvania's Muslim Student Association, said he believes police are wasting their time by watching college students.

"What do they expect to find here?" Munir said. "These are all kids coming from rich families or good families, and they're just trying to make a living, have a good career, have a good college experience. It's a futile allocation of resources."

NEW ORLEANS (AP) ? A minority partner in BP's blown-out well in the Gulf of Mexico agreed Friday to pay $90 million in a settlement with the federal government and Gulf states over the 2010 oil spill. It includes the largest civil penalty ever recovered under the federal Clean Water Act.

MOEX Offshore 2007 LLC owned 10 percent interest in the Macondo well, about 50 miles off the Louisiana coast. The well blew out in April 2010, destroying the BP-leased rig Deepwater Horizon, killing 11 men and resulting in the nation's worst offshore oil spill.

The agreement, filed in U.S. District Court in New Orleans, calls for MOEX to pay $45 million in civil penalties to the federal government and $25 million to the Gulf states affected by the spill. The company also agreed to pay $20 million for coastal protection projects.

The Justice Department said the agreement is the largest civil penalty ever recovered under the clean water law that was enacted in 1972.

"The Department of Justice has not wavered in its commitment to hold all responsible parties fully accountable for what stands as the largest oil spill in U.S. history," said Attorney General Eric Holder said in a statement. "This landmark settlement is an important step ? but only a first step ? toward achieving accountability and protecting the future of the Gulf ecosystem by funding critical habitat preservation projects."

MOEX is the first company involved in the disaster to settle with the federal government over the spill. The federal government also sued BP, rig owner Transocean Ltd. and another minority partner in the well, Anadarko Petroleum Corp.

A federal trial in New Orleans designed to determine the causes of the blowout that spewed millions of gallons of oil into the Gulf is scheduled to start Feb. 27.

MOEX Offshore, a wholly owned subsidiary of MOEX USA Corp. and unit of Japanese trading house Mitsui & Co., no longer owns any share of the lease for the Macondo well.

In May 2011, MOEX Offshore agreed to pay BP more than $1 billion to settle all claims between the companies.

The federal government's $45 million share of the civil penalties will go toward replenishing the Oil Spill Liability Trust Fund, which covers the cost of cleanup and damage from future spills.

Louisiana's share of the civil penalties is $6.75 million. Alabama, Florida and Mississippi will each get $5 million, while Texas gets $3.25 million.

MOEX officials could not immediately be reached for comment.
